Cleburne County } In Vacation August 16, 1878

This day came Lewis Coffey administrator in this Court of the estate of Abner Coffey deceased and filed his application in writing and under oath, praying for an order and proceedings to sell certain real estate in said petition described of the property of said decedent for the purpose of paying the debts of due from said estate upon the ground that the personal property belonging to said estate is insufficient for those purposes, and it appearing from said petition that the only heirs of said decedent are Martha J. Coffey widow of said decedent who is over the age of twenty one years of age of sound mind and resides in the State of Texas County of (blank), Post Office (blank), Lewis Coffey who is over the age of twenty one years of sound mind and resides in Cleburne County, Alabama, Emmiline Henry who is over the age of twenty one years of sound mind and resides in Cleburne County Alabama, and Martha J. Harris wife of Pat Harris and Martha Owen, wife of B. D. Owen, each of whom are over the age of 21 years and who reside in Cleburne County, Alabama, Levi Coffey who is over the age of twenty one years of sound mind and resides in the State of Mississippi, County of Leak Post Office Conway, Elijah Coffey who is over the age of twenty one years of sound mind and resides in Cleburne County Alabama, Young H. Coffey and Elizabeth Coffey each of whom are under the age of twenty one years and resides in the State of Texas with their mother widow of said decedent. William, Susan and Jesse Harris each of whom are under the age of twenty one years and reside in Cleburne County Alabama, Lucy Edmondson, William Edmondson, Lewis Coffey Jr and Stephen Coffey each of whom are under the age of twenty one years of sound mind and reside in Cleburne County, Alabama. It is therefore ordered that W. T. Noell be appointed guardian ad litem for the said Young H. Coffey, Elizabeth Coffey, Wm Haris, Susan Harris, Jessee Harris, Lucy Edmondson, William Edmondson, Lewis Coffey Jr and Stephen Coffey, and that the 30 day of September 1878 be and is hereby appointed a day on which to hear the said application, and the proof which may be submitted in support of the same. And it further ordered that due notice of the nature of said application and of the time above set for the hearing thereof be given at least three weeks before the said day of hearing by posting of advertisements at the Court house door, and at three other public places in said notifying all persons in interest to appear and contest said application if they think proper, there being no newspaper published in Cleburne County. It is further ordered that Lewis Coffey, Emiline Henry, Elijah Coffey and W. T. Noell guardian ad litem for Young H. Coffey, Elizabeth Coffey, Wm Harris, Susan Harris, Jessee Harris, Lucy Edmondson, Wm Edmondson, Stephen Coffey and Lewis Coffey and Mary J. Harris and her husband Pat Harris and Martha Owen and her husband B. D. Owen have notice of this proceeding and of the day set for hearing the same by citation to be personally served upon them ten days before the day for hearing the same. It is further ordered that a copy of said posted advertisement be forwarded through the mails postage paid addressed to the said Martha J. Coffey at the said _________ State of Texas and a copy to Levi Coffey addressed to him postage paid at Conway, State of Mississippi, written one day from the date of this order. It is further ordered that testimony be taken as in Chancery Proceedings showing the necessity of said sale as required by law upon ____ filed and propounded to at least two ____ interested witnesses..

Cleburne County } In vacation January 7, 1879

This day came Lewis Coffee administrator of the estate of Abner Coffee, deceased, and makes report in writing and under oath of the sale of the real estate of said deceased praying that the sale of said lands be confirmed by this court. And it appearing to the Court from people's evidence that said administration was authorized and empowered by an order of sale made and entered in this court on the 30th day of September 1878 to sell the lands therein described belonging to said estate for the purpose of paying the debts due from said estate, in manner and form as the law directs and as prescribed in said decree of sale. And it appearing to the satisfaction of the court from peoples evidence that said sale was in all respects regular and as prescribed by law and said order of sale. And that at said sale, made on the 8th day of September 1878. William H. Rhodes became the purchaser of part of the South East fourth of the South East quarter of Section thirty one (31) in Township fifteen (15) of Range Eleven (11) and the East half of the North East quarter and the South West fourth of the North East quarter of Section Six (6) and eight acres more or less in the South East corner of the South West fourth of the South East quarter of Section Six (6) and Seven acres more or less in the North West corner of the South East quarter of Section Six (6) all of said lands in Section Six (6) in Township Sixteen of Range Eleven all situated in the County of Cleburne State of Alabama at the price of four hundred and sixty five dollars. One hundred dollars of said purchase for cash the remainder on account of twelve months; and that the said William H. Rhodes has fully complied with the terms of said sale, and it further appearing to the Court that said sale was fairly conducted and that said lands sold for a price not greatly disproportionate to its real value. It is ordered and judged and decreed that said sale of the above described lands be ____ the same is hereby in all ____ confirmed. It is further ordered that said report be and the same is hereby approved and ordered to be filed and recorded in this court.
